According to the old rules, a teacher who wanted to earn more could, at his own request, apply for assignment to the second, first or highest category. The categories were assigned: the second - by the leadership of the preschool educational institution, the first - by the district education department, and the highest - by the ministry.
According to the new rules, the second category was canceled altogether, and certification teaching staff entrusted to educational authorities at the level of the constituent entity of the Russian Federation. At the same time, certification has become mandatory: once every five years, every teacher who does not have a category, regardless of desire and work experience, must undergo certification in order to confirm compliance with the position held.
The same teachers who want to get their first or highest category, may instead apply for certification to determine whether their professional level meets the requirements for qualification categories. Categories are assigned for 5 years, after which they must be confirmed again in the same order.

If the teacher does not confirm his category in time, it will be cancelled.

After this :
-a teaching worker of the first category will have to either submit an application for certification to be assigned the first category, or general procedure undergo certification to confirm compliance;
-a teaching worker of the highest category will be forced to first be certified for the first category, and only after two years he will receive the right to apply for the highest.

At the same time, qualification categories assigned before January 1, 2011 remain valid for the period for which they were assigned. However, the rule according to which a teacher who has worked in the profession for 20 years was assigned the second category “for life” is cancelled. From now on, these teachers will also have to undergo certification every five years.

Mandatory certification for suitability for the position held

Mandatory certification is carried out every five years to confirm the suitability of the teaching staff for the position held.

Teaching staff who do not have categories and have not expressed a desire to undergo certification for a qualification category.

-teachers who have worked for less than 2 years in this position;
-pregnant women and women in maternity leave and on parental leave until the child reaches the age of 3 years. Their certification is carried out no earlier than two years after leaving the specified vacations.

Teachers are represented by their employer for certification in order to confirm their suitability for the position held.

In case it does not work in different teaching positions with one employer and for none of them has qualification category, then the employer’s submission can be submitted immediately for all positions in which he is employed.

If a teacher combines work in his specialty with several employers, each of them has the right to send him for certification.


The employer draws up a representation for the teacher. The submission is completed in accordance with the established form (there is a sample). In this document, the employer comprehensively evaluates the professional skills of the teacher and his work in his position. The document must also contain information about the teacher’s completion of advanced training courses and information about the results of previous certifications.
No later than a month before the start of the certification, the employer, against signature, acquaints the teacher with the presentation.
The employer submits documents to the certification commission of the constituent entity of the Russian Federation, where it receives information about the date, place and time of the teacher certification.
The certification period should not exceed 2 months. No later than a month before the certification, the employer brings to the attention of the teaching worker information about the date, place and time of his certification.

How is certification carried out?

During certification, in order to confirm compliance with the position held by teachers, they undergo written tests on issues related to their professional activities or computer testing, which allows them to determine their level of proficiency. modern techniques teaching and education.

Commission decision

In accordance with paragraph 13 of the “Procedure for Certification of Teaching Workers,” the decision of the certification commission is documented in a protocol and entered into the certification sheet of the teaching worker. This document, as well as an extract from the administrative act of the certification commission, are stored in the teacher’s personal file.
Upon successful completion of the certification, the commission issues a verdict: “suitable for the position held.”
If the tests are failed, the commission decides that the teacher is “not suitable for his position.”

In this case employment contract with a teaching employee may be terminated in accordance with clause 3. part 1. art. 81 Labor Code of the Russian Federation. However, the employer is not obliged to fire a teacher who has not passed the certification. For example, he may offer him to take advanced training courses and, upon completion, undergo re-certification.

In addition, dismissal is not allowed if it is possible to transfer the teaching employee with his written consent to another job (for example, a vacant lower position or a lower paid job).

Also, in accordance with Article 261 of the Labor Code of the Russian Federation, it is impossible to dismiss
-an employee during the period of his temporary disability and while on vacation;
-a pregnant woman, as well as a woman with children under three years of age;
a single mother raising a child under fourteen years of age or a disabled child up to eighteen years of age;
- other persons raising these children without a mother.

Voluntary certification for obtaining the first or highest category

Voluntary certification is carried out on the basis of an application from a teaching worker to determine whether his qualifications meet the requirements for the first or highest qualification categories.

Who is eligible to undergo certification?

1. An application for certification for assignment to the first category may be submitted by:
-teaching workers who have no categories;
- teaching staff with the first category - if the validity period of the previous “voluntary certification” is coming to an end.

2. An application for certification for assignment to the first category can be submitted by:
- teaching staff with the first category - but not earlier than 2 years after its assignment;
- teaching staff with the highest category - if the validity period of the previous “voluntary certification” is coming to an end.

Teachers who have worked in their position for less than 2 years, pregnant women and women on maternity leave to care for a child until the child reaches the age of 3 years also have the right to submit an application for voluntary certification.

Who is applying for certification?

Each teacher does this independently. The law does not establish centralized deadlines for submitting applications and periods for certification, so a teacher can submit documents for certification at any time.

Teachers who already have a category are recommended to submit an application no later than three months before the expiration of the previous voluntary certification. This is necessary so that this period does not expire during the consideration of the application and certification.

How to submit documents for certification

1. A teacher who decides to submit an application for voluntary certification collects a package of documents:
- application in the prescribed form (there is a sample);
- a photocopy of the certification sheet of the previous certification (if there was one);
- a new certification sheet filled out up to point 7 inclusive;
-a portfolio of your professional achievements (there are recommendations for compilation), which can be submitted to the certification commission both at the time of submitting the application and within a month after that.

According to the “Procedure for Certification of Teaching Workers,” the following requirements are imposed on the categories.

Requirements for the first qualification category:

-stable results of mastering by students, pupils educational programs and the indicators of the dynamics of their achievements are above average in the constituent entity of the Russian Federation.

Requirements for the highest qualification category:
-the first qualification category has been established;
- mastery of modern educational technologies and methods and their effective application in practice;
-stable results of students mastering educational programs and -indicators of the dynamics of their achievements are above average in the constituent entity of the Russian Federation, including taking into account the results of -participation of students and pupils in all-Russian, international olympiads, competitions, competitions;
-personal contribution to improving the quality of education based on improving teaching and upbringing methods, innovative activities, in the development of new educational technologies and active dissemination own experience in the field of improving the quality of education and upbringing.

At the same time, olympiads, competitions and competitions are taken into account only for the assessment of those teaching staff whose work includes these events. For example, for educational psychologists this point is not valid.

How is certification carried out?

The qualification test takes the form of an examination of the teacher’s portfolio of professional achievements. The meeting of the certification commission can take place either without the participation of the teacher undergoing testing, or in his presence. You must write in advance in your application if you wish to attend the meeting.

If the teacher stated his desire to attend the meeting, but did not appear at the specified time without good reason, the certification commission has the right to conduct certification in his absence.

Commission decision

During certification, to establish compliance of their professional level with the requirements for qualification categories, the decision of the commission is recorded and recorded on the certification sheet of the teaching worker. Then it is approved by the educational authorities of the constituent entity of the Russian Federation. The certification sheet and an extract from the act of the educational authority are sent to the employer.

1. If the teacher has passed certification, a decision is made “meets the requirements for the first (highest) qualification category.

In this case, the qualification category is assigned to the teaching worker from the day the certification commission makes the corresponding decision. From the same date, the teacher has the right to wages in accordance with his category.

A record of category assignment is made in work book, in the “Job Details” section. For example: “The first qualification category for the position of “teacher” has been established - but the subject taught is not indicated.

2. If the teacher has not passed certification, a decision is made “does not meet the requirements for the first (highest) qualification category.”

In this case, those who “passed” for the first category remain without a category and must undergo certification for suitability for the position held.

Those who “failed” to the highest level are retained in the first qualification category until its expiration date. After which the certification will have to be taken again - either to confirm the first category, or to establish the highest.

Appealing the decision of the certification commission

The right to appeal the results of certification is stipulated in the “Procedure for certification of teaching staff.” You can file an appeal either to the labor dispute commission at the regional education authority or to the court. An application to the court to resolve an individual labor dispute is filed within three months from the day the employee learned or should have learned of a violation of his rights.

In accordance with the law “On Education in Russian Federation» teaching staff of organizations implementing educational activities must undergo certification. Certification is important not only for the teaching staff themselves (it stimulates their professional and personal growth, increasing wages, etc.), but is also aimed at improving the quality of education based on increasing the efficiency and quality of their pedagogical activity. Order of the Ministry of Education and Science of the Russian Federation dated April 7, 2014 N 276 (registered with the Ministry of Justice of the Russian Federation on May 23, 2014 Registration N 32408) approved a new Procedure for the certification of teaching staff of organizations engaged in educational activities (hereinafter referred to as the Procedure). In this connection, order of the Ministry of Education and Science of the Russian Federation dated March 24, 2010 N 209 “On the Procedure for Certification of Teaching Employees of State and Municipal educational institutions"(registered by the Ministry of Justice of the Russian Federation on April 26, 2010, registration No. 16999) becomes invalid.

What's new?

1.About the qualification categories available to employees

It has been established that qualification categories previously established for teachers of state and municipal educational institutions, are retained for the period for which they were established.

2. Types of certification

  • mandatory - in order to confirm the compliance of teaching staff with the positions they occupy based on an assessment of their professional activities;
  • voluntary - at the request of the teacher in order to establish the first or highest qualification category.

3.Who is certified

All teachers of educational organizations carrying out educational activities are certified, including part-time workers, as well as employees who combine positions along with work in the same organization, determined by the employment contract.

4. Who is exempt from certification?

Approved Procedure does not concern teaching staff.

Certification to confirm compliance with the position held don't pass the following teachers:

a) teaching staff, having qualification categories;

b) who have worked in their current position less than two years in the organization, in which certification is carried out;

V) pregnant women;

G) women on maternity leave. Their certification is possible no earlier than in two years

d) persons on parental leave until they reach the age ofage three years. Their certification is possible no earlier than two years after leaving the specified vacation;

e ) absent from work for more than four months in a row inconnection with the disease. Their certification is possible not earlier than in a year after going back to work.

5.Frequency and timing of certification

6.Principles of certification

Collegiality, publicity, openness, ensuring an objective attitude towards teaching staff, inadmissibility of discrimination during certification.

7.Certification procedure

The document details the procedure for certifying teaching staff for suitability for the position held and assigning them qualification categories. It was established that:

a) In accordance with the Procedure, certification of teaching staff in order to confirm compliance with the positions they occupy based on an assessment of their professional activities is carried out certification commissions, independently formed educational organizations , in accordance with the employer's administrative act.

The organization's certification commission must include the chairman of the commission, the deputy chairman, the secretary and members of the commission, as well as mandatory representative of an elected body the corresponding primary trade union organization (if there is such a body).

When making decisions, certification commissions of organizations also give recommendations to the employer on the possibility of appointing teaching staff to the appropriate positions. persons who do not have special training or work experience, established in the “Qualification Requirements” section of the “ Qualification characteristics positions of education workers" of the Unified Qualification Directory of positions of managers, specialists and employees and (or) professional standards, but with sufficient practical experience and competence, performing efficiently and in full the duties assigned to them.

b) Certification of teaching staff in order to establish a qualification category is carried out:

  • for teaching staff of organizations under the jurisdiction of federal bodies executive branch, - certification commissions formed federal authorities the executive authorities, under whose jurisdiction these organizations are;
  • in relation to teaching staff of organizations under the jurisdiction of a constituent entity of the Russian Federation, teaching staff of municipal and private organizations - by certification commissions formed authorized bodies state authorities of the constituent entities of the Russian Federation.

Certification of teaching staff is carried out on the basis of their applications submitted directly to the certification commission, or sent by teaching staff to the certification commission by mail with a return receipt or notification in the form electronic document using information and telecommunication networks public use, including the Internet.

It has been established that applications for certification for the assignment of a qualification category are submitted by teaching staff, regardless of the duration of their work in the organization, including while on parental leave.

Applications for certification in order to establish the highest qualification category for the position for which certification will be carried out for the first time are submitted by teaching staff no earlier thanin two years after the first qualification category has been established for this position.

The expiration of the highest qualification category does not limit the right of a teaching worker to subsequently apply to the certification commission for certification in order to establish the highest qualification category for the same position.

Pedagogical workers who, during certification refused to establish a qualification category, apply at their request to the certification commission with an application for certification for the same qualification category not earlier than in a year from the date the certification commission makes the corresponding decision.

When teaching staff transfer to another organization, including one located in another constituent entity of the Russian Federation, the qualification categories established by it are retained until their expiration date.

Appealing certification results

The employee has the right to appeal the results of certification in accordance with the legislation of the Russian Federation.

Since January 1, 2011, the procedure in which the certification of kindergarten and school teachers took place has changed.

What happened?

As you know, there is mandatory and voluntary certification. The first task is to confirm the teacher’s suitability for the position he occupies. The second occurs when it comes to raising the qualification category.

According to the rules in force earlier, if a teacher wanted to increase his salary, he, on his own initiative, submitted an application requesting assignment to one of the categories - highest, first or second. This was done by the management of the child care institution or the educational management body.

Later, the second category was canceled as such. Certification began to be managed by educational authorities at the level of the constituent entity of the Russian Federation. The main thing: this procedure is now mandatory. Once every five years, absolutely all teachers with any length of service, regardless of own desire, must pass it to confirm their suitability for the position they occupy.

Who needs a category

Teacher certification kindergarten for the first category (or higher) is optional. Those who want to receive it have the right to submit an application. Its purpose is for them to be certified. That is, they established the correspondence of the professional level of the categories. Any of them is assigned for a period of 5 years, then requires renewal in a similar manner.

If the teacher’s qualification is not confirmed in a timely manner, it is automatically reduced. What then?

A former employee of the first category will have to reapply for certification (in order to restore it).

What if he doesn't do this? In this case, among others, be certified to confirm compliance.

The one who has lost the highest will have to “go through” everything again. First, you will need certification of a teacher for category 1. And no earlier than after two years he will have the right to take the higher level.

Categories received before the specified date (1/1/2011) are valid until the end of the assignment period. But the old provision - after 20 years the second category remains forever - has now been abolished. These educators will also have to confirm their professional suitability every five years.

What is certification like?

Let's consider both of its types - mandatory and voluntary.

The first, as already mentioned, must take place once every five years. Its purpose is to confirm that the teacher is suitable for his position. All employees who do not have categories and have no desire to receive them are required to pass it.

Those holding a position for no more than 2 years, mothers on maternity leave and pregnant women are exempt from certification. The deadline for them will come no earlier than two years after the end of the leave granted to care for the child.

The employer submits the teacher for certification. If a teacher holds several positions in one institution at once, and is not certified in any of them, then it is possible for all of them at once.

If he works part-time in different places, then each employer is authorized to send him for certification.

How are documents submitted?

The application for a teacher is drawn up by the employer according to the established template. The document contains all the necessary certificates for the certification of a teacher, a detailed comprehensive assessment of the employee’s professional skills and the quality of his work in the position. In addition, there is information about all advanced training courses completed and the results of past certifications.

A month before the test, the teacher is introduced to the performance under signature. The documents are submitted by the employer to the certification commission of the relevant constituent entity of the Russian Federation, where its date, time and place are set. The duration of its completion should not be more than two months.

How does it go?

Certification of senior and other employees is carried out in in the prescribed manner. During the process, to confirm their qualifications, subjects undergo examinations in in writing or computer testing. Their purpose is to identify the level of proficiency in professional methods modern learning, confirm the valuable experience of working as a preschool teacher and the level of one’s own competence.

The decision made by the commission is drawn up in the form of a protocol and entered into the employee’s certification sheet. The latter is kept in the teacher’s personal file.

If the certification is completed successfully, the commission’s verdict is “corresponding to the position held.” Otherwise - “does not correspond”.

If you're unlucky

In the latter case, the employer has the legal right to terminate the contract with the employee, but is not obliged to do so. He may suggest that he take advanced training courses and then re-pass the certification.

Instead of dismissal, the employee can and should be transferred, with his consent, to another position (lower), if there is a vacancy. They also do not have the right to deprive a temporarily disabled person of work, a pregnant woman, a woman with children under 3 years of age, or a single mother with a child under 14 years of age or a disabled child.

Voluntary certification

It is organized to assign the first (or highest) category at the initiative of the employee and on the basis of his application. Its purpose is to establish compliance of the teacher’s qualifications with the requirements of the declared category.

Employees who do not yet have any have the right to apply for the first one. Or those whose validity period for the previously received 1st category is coming to an end. For higher education - those who received their first two or more years ago, as well as those wishing to extend their existing one.

An application for teacher certification is submitted by the teacher independently at any time. To ensure that the previous application does not expire during the period of its consideration, it is recommended to submit it in advance - 3 months in advance.

How to properly prepare documents

Their complete package must include an application for certification according to the sample, a previous certification sheet (photocopy) - if available, completed new leaf, portfolio of achievements. There are methodological recommendations for compiling the latter.

Documents submitted to the certification commission of a local constituent entity of the Russian Federation are usually reviewed for about a month, then a place and date are assigned. It should only take place for a certain period of time.

A statement of intent to attend the discussion must be included in the certification application in advance. After this, it is approved by a higher authority - at the level of the subject of the Russian Federation. What then?

If the certification of a kindergarten teacher for the first category (or the highest) was successful, and a decision was made on compliance with the necessary requirements, the date of assignment of the corresponding category is considered the day the commission made the decision. From this moment on, teachers will also be paid at the new rate.

An entry indicating that a certain category has been assigned must be made in the work book.

In case of “failure” of certification, a decision “does not meet the requirements” is made. Then those applying for the first category are left without one and are required to be certified for suitability for the position they occupy.

Those who “did not pass” remain in the first category until the end of the current period. Then the teacher has the right to try again to “earn” the highest category, or he will have to confirm the first one.

Appealing the results of certification

The right to such an appeal is documented. This is done by submitting an application to the labor dispute commission or even to the court, and in the latter case it is important to do this within three months from the date of certification.

But in practice, such situations happen extremely rarely. As a rule, teachers submit documents for certification being thoroughly prepared - having thoroughly studied all the necessary requirements, preparing a competent and worthy portfolio and being completely confident in their own abilities.
